Wall Street Journal: A Patent Rule Worth Defending by Paul Michel

In his op-ed “Patent Litigation Is a Matter of National Security” (Sept. 11), former U.S. Attorney General Michael Mukasey claims that the NHK-Fintiv ruling—a 2020 reform implemented by the U.S. Patent and Trademark Office—forces the “targets of meritless infringement litigation [to] choose between settling out of court or entering a costly legal battle.” But the rule doesn’t make anyone enter a costly legal battle.
