Innovation Alliance Statement on Senate Judiciary Committee’s Passage of PREVAIL Act
Committee Advances Critical Bill to Restore Fairness at the PTAB and
to Promote U.S. Innovation and Global Technological Leadership
WASHINGTON, D.C. – Innovation Alliance Executive Director Brian Pomper today issued the following statement on the U.S. Senate Judiciary Committee’s passage of the bipartisan, bicameral Promoting and Respecting Economically Vital American Innovation Leadership Act (PREVAIL) Act (S.2220/H.R.4370):
“Today is an important day for American innovation and competitiveness. The Senate Judiciary Committee’s passage of the bipartisan, bicameral PREVAIL Act represents a vital step in strengthening inventors’ rights and the U.S. innovation economy. This is the first time in more than three decades that a Committee of Congress has moved forward on a bill to protect patent rights. The PREVAIL Act will restore much-needed fairness to the USPTO’s Patent Trial and Appeal Board (PTAB) process, help protect American innovators from harassment by Big Tech and other companies who violate intellectual property rights, and promote U.S. technological advancement.
“The Innovation Alliance commends the Committee for this action, and we particularly thank Senate Judiciary IP Subcommittee Chair Chris Coons (D-DE) and Ranking Member Thom Tillis (R-NC), along with the other bill co-sponsors, for their leadership in this critical area of innovation policy. We urge Congress to take up and pass the PREVAIL Act as soon as possible.”
